- Who needs an Authorized Representative in Romania?Foreign companies (EU and non-EU) that place packaged products, batteries or electrical and electronic equipment on the Romanian market are required to appoint a locally established Authorized Representative. For packaging specifically, this obligation already exists today under Romanian law — Government Emergency Ordinance 92/2021 on the waste regime, Art. 12(12)-(13) — years ahead of the EU-wide PPWR requirement (Regulation (EU) 2025/40, Art. 45) that applies from 12 August 2026.
- What happens if I don't appoint one?Selling without meeting your EPR obligations can expose you to fines under Romanian law (Legea 249/2015 sets fines up to 50,000 lei depending on the breach) and compliance risk with Romanian authorities.
